Legal Requirements for Landlords

I've heard about all these new rules and regulations regarding letting my property. What are my obligations and what are the pitfalls?

There have been several developments recently which has meant that letting your property is no longer just a case of putting an advert in the newspaper and waiting for the phone to ring. Below is a brief overview of the recent regulations. Tenants Deposit Protection
Since April 2007 virtually all new Tenancies must comply with the above regulations. Deposits will need to be registered with one of 3 schemes within 14 days of receipt of deposit. Failure to comply will affect your ability to remove your tenants with a Section 21 notice, and could result in you having to pay substantial compensation to your tenants. The scheme also includes a dispute resolution service. PAT Testing
PAT Testing or Portable Electrical Appliance Testing is NOT compulsory, for residential lettings, however it is considered best practice and we do not manage any properties without a current PAT Test

Gas Safety Testing
All gas appliances must be serviced and tested every year. These regulations have been in force since 1994. As your managing agent we will arrange this on your behalf. If we act for you on a Let Only basis, it is your responsibility to provide a current certificate. We will not let people take possession without a valid certificate.

Houses in Multiple Occupation (HMO) Licensing
After years of confusion an attempt was recently made to clarify this situation and the result was ... more confusion. The regulations are difficult to comprehend and are subject to local variation.
